This article analyzes the unpublished dialogue between James Baldwin and Reinhold Niebuhr where they discussed the role of the Christian church in the wake of six child murders in Birmingham, Alabama on September 15, 1963. On that catastrophic day—one that is impossible to forget—the Ku Klux Klan bombed The Sixteenth Street Baptist Church, and two black boys were subsequently shot and killed. In the wake of that violence, this article will show that for Baldwin, the dynamite that exploded the face (...) of the “alabaster Christ” from the stained-glass window presents an opportunity for not only a new depiction of Jesus in terms of presentation—but more significantly—a brand-new Christology rooted in black liberation. Such a reading provides us with an unusual constructive theological position offered by Baldwin, especially once it is read alongside a public essay written by the Association of Artists for Freedom advocating for Black Christmas. This article explores a phenomenon found in Berber whereby the extraction of dative arguments (of verbs, nouns and prepositions) gives rise to two occurrences of wh. One is a wh-word located in Spec,C and the other a wh-clitic in the dative form located in C (wh-clitic-doubling). Close examination reveals that the wh-word in Spec,C functions as an operator base-generated in its scope position and the dative wh-clitic in C provides it with a derivational link to the variable in the dative (...) position it binds (wh-Cliticisation). Wh-clitic-doubling and wh-Cliticisation amount to direct evidence for Cliticisation as a derivational interpretive mechanism of Grammar that obviates the need for indexing (Lebeaux 1983, Chomsky 1986, 1995). They also provide evidence for the conclusion in Kayne (1989) that Cliticisation is an instance of Head-Movement, more precisely, feature-based Head-Movement. (shrink)

As a type of evidence glass can be very useful contact trace material in a wide range of offences including burglaries and robberies, hit-and-run accidents, murders, assaults, ram-raids, criminal damage and thefts of and from motor vehicles. All of that offer the potential for glass fragments to be transferred from anything made of glass which breaks, to whoever or whatever was responsible. Variation in manufacture of glass allows considerable discrimination even with tiny fragments. In this study, we worked glass classification (...) and testing of artificial neural network model created by the JustNN. The aim of the study is help investigator in identifying the type of glass found in arena of the crime. The Neural Network model was trained and validated using the type of glass dataset. The accuracy of model in predicting the type of glass reached 96.7%. Thus neural network is suitable for predicating type of glasses. (shrink)

In many areas, technology has facilitated many things, diagnosing diseases, regulating traffic and teaching students in schools rely on Intelligent systems to name a few. At present, traditional classroom-based education is no longer the most appropriate in schools. From here, the idea of intelligent e-learning for students to increase their culture and keep them updated in life began. E-learning has become an ideal solution, relying on artificial intelligence, which has a footprint in this through the development of systems based on (...) education without a teacher taking into account the individual differences of students. This study describes intelligent tutoring system for teaching the Data Manipulation Language (DML) Commands Using SQLite to non IT students to overcome the difficulties they face. The System was built as education system by using the researcher own authoring tool that based on mobile and web App. The basic idea of this system is a systematic introduction into the concept of Database and its DML query. The system presents the topic of DML Commands, help student to execute what they are learn from the system content using the practical part of the system and administers automatically adapted at run time to the student’s individual growth. The system was assessed by a group of teachers and students and the outcome showed as 91% from the database specialists, 94% from Diploma students group and 89% from the secondary school students group. Este ensayo aborda el curioso desdén que muchos originalistas muestran respecto de la Enmienda Decimocuarta a la Constitución estadounidense. De acuerdo a las premisas teóricas originalistas, el análisis del texto, la historia y la estructura de esta Enmienda deberían ocupar un lugar central en las discusiones sobre derechos incorporados, acción afirmativa y federalismo; sin embargo, en estas discusiones los originalistas la minimizan, como lo hacen, en general, con el período de la Reconstrucción. El artículo sugiere que tanto la Enmienda como (...) la Reconstrucción representan para ellos una historia poco útil, en comparación con la del momento de la Fundación, por varias razones: las enmiendas de la Reconstrucción fueron en gran parte fracasos en su tiempo; el lenguaje abstracto de la Enmienda XIV no facilita la resolución de las controversias actuales sobre su significado, y la Reconstrucción se asocia en la memoria nacional con un momento doloroso de división y guerra civil. Respect for patient autonomy has served as the dominant ethical principle of genetic counselling, but as we move into a genomic era, it is time to actively re-examine the role that this principle plays in genetic counselling practice. In this paper, we argue that the field of genetic counselling should move away from its emphasis on patient autonomy and toward the incorporation of a more balanced set of principles that allows counsellors to offer clear guidance about how best to obtain (...) or use genetic information. We begin with a brief history of how respect for patient autonomy gained such emphasis in the field and how it has taken on various manifestations over time, including the problematic concept of nondirectiveness. After acknowledging the field's preliminary move away from nondirectiveness, we turn to a series of arguments about why the continued dominance of patient autonomy has become untenable given the arrival of the genomic era. To conclude, we describe how a more complete set of bioethical principles can be adapted and used by genetic counsellors to strengthen their practice without undermining patient autonomy. (shrink)

Some aspects of the Schrödinger equation in quantum field theory are considered in this article. The emphasis is on the Schrödinger functional equation for Yang-Mills theory, arising mainly out of Feynman's work on (2+1)-dimensional Yang-Mills theory, which he studied with a view to explaining the confinement of gluons. The author extended Feynman's work in two earlier papers, and the present article is partly a review of Feynman's and the author's work and some further extension of the latter. The primary motivation (...) of this article is to suggest that considering the Schrödinger functional equation in the context of Yang-Mills theory may contribute significantly to the solution of the confinement and related problems, an aspect which, in the author's opinion, has not received the attention it deserves. The relation of this problem with certain others such as those of quarks, superconductivity, and quantum gravity is considered briefly, together with certain basic aspects of the formalism that may be of interest in their own right, especially for the beginner. Tourism is a complex phenomenon in scale and scope. Interrelated with other systems from the local to the global, its impacts and effects transcend borders, making coordination and regulation highly challenging. Global mobilities and neoliberal globalization further complicate enabling just and sustainable tourism. New forms of governance are needed to address global threats like climate change and pandemics. This paper explores Immanuel Kant’s transcendental perspective on “perpetual peace” and traces his evolving cosmopolitanism over a decade of essays. We then turn (...) towards what appears to be a contradictory, immanent posthumanist approach from Gilles Deleuze. Radicalizing Kant using Deleuze leads to a different concept of ‘normativity’, grounded in an ideal of perpetual self-critique and self-creation. Such a critical, affirmative ethic opens possibilities for situated approaches to cosmopolitan rights and global justice, rather than global regulatory structures to coordinate effective and proactive actions. This paper analyzes how national institutions impact corporate social responsibility practices for small- and medium-sized enterprises in the food-processing industries of France and Morocco. In this study, CSR practices are defined around two main dimensions: corporate performance and the CSR approach. Qualitative data were collected during semi-structured interviews with SME managers in charge of CSR issues. We then performed a content analysis. Our study shows that there is a distinct difference between the CSR practices adopted by SMEs in France and (...) Morocco. Indeed, the findings suggest that under the rule-based governance system of France, most SMEs view CSR as an economic tool and it is adopted as an opportunity-seeking perspective anchored in the search for global performance. The findings also show that under the relationship-based governance system of Morocco, SMEs mainly see CSR from a constraint-reducing perspective. However, some Moroccan SMEs have begun to see the economic opportunities of CSR, especially in accessing foreign markets. (shrink)

This paper compares the cases of female ailments recorded in the Epidaurian Miracles Cures with the theory and therapeutics of the Hippocratic gynecological texts as a means of testing the extent of the assumptions shared between temple and Hippocratic medicine. I argue that where temple and Hippocratic practice hold common ground, it is readily explicable through widely circulating and historically rooted cultural presuppositions regarding female physiology and pathology, rather than through scientific borrowings. Rather than representing complementary outlets of medical care (...) in which Asklepios specialized in “hopeless” cases, I suggest that the iamata permit us to observe a process in which parallel medical traditions branched out from a common cultural substratum, and that more nuance is required in framing the relationship between Greek naturalist and religious medicine. Sound symbolism refers to non‐arbitrary mappings between the sounds of words and their meanings and is often studied by pairing auditory pseudowords such as “maluma” and “takete” with rounded and pointed visual shapes, respectively. However, it is unclear what auditory properties of pseudowords contribute to their perception as rounded or pointed. Here, we compared perceptual ratings of the roundedness/pointedness of large sets of pseudowords and shapes to their acoustic and visual properties using a novel application of representational similarity analysis (RSA). (...) Representational dissimilarity matrices (RDMs) of the auditory and visual ratings of roundedness/pointedness were significantly correlated crossmodally. The auditory perceptual RDM correlated significantly with RDMs of spectral tilt, the temporal fast Fourier transform (FFT), and the speech envelope. Conventional correlational analyses showed that ratings of pseudowords transitioned from rounded to pointed as vocal roughness (as measured by the harmonics‐to‐noise ratio, pulse number, fraction of unvoiced frames, mean autocorrelation, shimmer, and jitter) increased. The visual perceptual RDM correlated significantly with RDMs of global indices of visual shape (the simple matching coefficient, image silhouette, image outlines, and Jaccard distance). Crossmodally, the RDMs of the auditory spectral parameters correlated weakly but significantly with those of the global indices of visual shape. Our work establishes the utility of RSA for analysis of large stimulus sets and offers novel insights into the stimulus parameters underlying sound symbolism, showing that sound‐to‐shape mapping is driven by acoustic properties of pseudowords and suggesting audiovisual cross‐modal correspondence as a basis for language users' sensitivity to this type of sound symbolism. The five books of Artemidorus of Ephesus’ Oneirocritica (c. second century CE) constitute the largest collection of divinatory dream-interpretations to survive from Graeco-Roman antiquity. This article examines Artemidorus’ contribution to longstanding medico-philosophical debates over the ontological and epistemic character of such dreams. As with wider Mediterranean traditions concerning premonitory dreams, Greeks and Romans popularly understood them as phenomena with origins exterior to the dreamer (e.g. a visitation of a god). Presocratic and Hippocratic thinkers, however, initiated an effort to bring at (...) least some dream events within the body as interior processes of a physical soul, a bodily turn which ultimately engendered a split in thinking about the possibility and scope of prophetic and diagnostic dreams (e.g. Hippocrates Regimen 4, Aristotle On Prophecy in Dreams, Rufus of Ephesus, and Galen). Here, I examine the way that Artemidorus meant the Oneirocritica to address seriously questions about the origins of dreams and the powers of empirical science in two, related ways. We will see that his defense of oneirocriticism as a techne unfolds along two main axes. First, Artemidorus constructs a necessary veneer of scientific credibility by mobilizing the tropes and organizational strategies characteristic of contemporary technical literature. Secondly, he anchors that authority upon a materialist account of prophetic dreams as “semiotic movements of the soul.” As Price, S. 1986. “The Future of Dreams: From Freud to Artemidorus.” Past & Present 113: 3–36 and Harris-McCoy, D. 2012. Artemidorus’ Oneirocritica: Text, Translation, and Commentary. Oxford: Oxford University Press observed, this explicit commitment to an empirical method of dream-interpretation resembles that of the Hellenistic medical ‘sect’ known as ‘Empiricists,’ who eschewed interest in theoretical etiology in favor of observation, comparison, and compilation of symptoms and outcomes. Pushing beyond similarity, I argue that Artemidorus not only deployed this method to defend empirically grounded accounts of dream-divination (cf. Cicero De div. 1), but endeavored to show that such a scientific method can be used to stabilize and corral productively the potentially infinite number of interpretations any dream-sign might bear without recourse to an underlying, causal theory. In Pakistan, as in many other societies, politico-religious movements or so-called Islamist fundamentalist movements are becoming an important site for women's activism as well as the harnessing of such activism to promote agendas that seem to undermine women's autonomy. This has become a concern for a growing feminist literature which from a variety of political and theoretical positions seeks to understand and explain the subject-position of Muslim women as politico-religious activists. This paper attempts a deconstructive reading of texts by leading (...) Pakistani feminist scholars as they attempt the difficult process of steering between fundamentalism and Orientalism in their accounts of ‘fundamentalist’ women in the political ideological space of Pakistan. Feminist scholarship on women in religious and right-wing social and political movements has moved from a reductive focus on causal or motivational factors to more sophisticated analyses explicating processes of agency and subject formation. With the aim of expanding and deepening this conceptual space, I will discuss some of my interactions with a group of women in the Jamaat-e-Islami in Pakistan, as we attempted to explore the complex meanings of ‘the modern’ that informed the self-understanding of my interviewees. My work (...) corroborates some of the contemporary scholarship on what is referred to as Political Islam in arguing that Islamist movements in Muslim societies are also the catalysts of modernization, rather than simply its interlocutors. This article argues that these processes of social and political organizing entail particular interrogations and the reconstituting of identities in ways that blur the line between ‘the religious’ and ‘the secular’. On the one hand, we need to understand Jamaat women's self-construction as religious or pious women; on the other hand, we must grasp the specificity of their claims to act as modern subjects situated in the time of political and cultural modernity. Moving beyond poetry’s affective and semantic powers, south Indian rubrics of poetic analysis often examined poetry’s metaphysical dimensions. The poeticians of the Telugu country developed an especially rich body of work in this field, elaborating an analysis of auspiciousness in poetry and classifying minor genres of praise poetry called cāṭuprabandha wherein auspiciousness was particularly important. This article focuses on one witness to that tradition, the Lakṣaṇadīpikā of Gaurana. Previous scholars have cited the Lakṣaṇadīpikā as exemplifying this particular strand of thinking (...) in poetics in Andhra and contiguous regions. This paper concentrates on the metaphysical evaluation of poetry offered in the Lakṣaṇadīpikā as a way of detailing its sources and its place in the history of Sanskrit poetics more generally. Gaurana’s work is shown here to constitute an attempt at revising and reinforcing this analytical method by linking it to wider Sanskritic traditions of scholarship and ritual, specifically tantra and astrology. Ultimately, the paper argues that Gaurana’s project was meant to support a larger social argument for brahmanical prerogatives in the domain of poetic work. (shrink)

Tourism literature has shown there is a disagreement amongst academics conducting tourism research as to whether tourism is an academic community, academic study, and/or academic discipline. These three terms are used loosely and change in meaning depending upon the author, source, context, and discipline of the author(s). The following paper identifies tourism’s current position in academia using these three ideas of academic acceptance as tools to guide the discussion. Also guiding the discussion are ideas from tourism scholars and Kuhn’s ideas (...) of what constitutes a discipline. The discussion leads to a debate about “truths” in tourism research. Recommendations regarding the advancement of tourism in academia via theory construction in the academic field of tourism are presented. (shrink)

Consumer surveys indicate that concerns about privacy are a principal factor discouraging consumers from shopping online. The keypublic policy issue regarding privacy is whether the US should follow its current self-regulation course, or whether a European style formal legal regulation approach should be adopted in the US.We conclude that the use of assurance seals has worked reasonably well and websites should be free to decide whether they have aprivacy seal or not. Given the narrow scope and the wide variety among (...) these seals, we do argue that the seals should commit themselves to the key features of a good privacy policy and that an opt-in provision be required. We believe that insufficient evidence exists to propose formal Government mandated Internet privacy regulation. (shrink)

This study investigates whether financial performance is affected by corporate violations of laws and regulations. In a sample of 128 publicly traded banks that were subject to enforcement actions by US regulatory authorities over a 20-year period, we observed a significant negative market reaction pursuant to the violations. However, the market reaction did not vary meaningfully in accordance with the severity or repetitiveness of the violation. The results of this study are in conformity with previous research on industries other than (...) banking, notably with regard to negative market reaction. This confirms that shareholders in the banking industry react in a manner considerably similar to their counterparts in other industries. (shrink)

The presence of research integrity (RI) policies in higher education institutions is a critical tool for good research governance. Despite the increased availability and visibility of RI policies at many universities around the world, the status of RI policies in African universities is unknown. We evaluated the prevalence of six key research integrity policies in African universities. We conducted a quantitative content analysis of research integrity (RI) policies at 283 African universities, selected based on the Scimago Research and Innovation Ranking (...) 2024. University websites were searched, and policies were coded as "Yes," "Not Available," or "Not Retrievable." Using SPSS 29, and Excel functions to perform data analysis, we evaluate the prevalence and patterns of policy availability across different regions and institutions of Africa. Only 20.67% of universities had RI policies in place, while 78.86% did not have such policies. Furthermore, 0.47% of universities’ RI policies were not retrievable. Most of the available RI policies were written in English (87%), with smaller portions in Arabic (9%) and French (4%). Southern Africa universities had the highest availability of RI policies (58.64%), while Central Africa had the lowest (3.70%). Northern Africa, despite the largest sample representation (n = 149), had substantial gaps in policy availability, with a low rate of universities having RI policies in place (8.95%). There was a strong positive correlation between having a research misconduct/plagiarism policy and a research integrity and ethics policy, while a positive moderate correlation was found between having a data management, repository, sharing, and use policy and the allegation on research misconduct/whistleblowing policy. This study reveals that Research Integrity (RI) policies across African universities are notably limited, with significant gaps, particularly in Northern and Central Africa. Therefore, research administration in African universities must prioritize the development of comprehensive RI policies, accompanied by regular training programs for staff and students to ensure their effective application. Additionally, these policies should be made publicly accessible to stakeholders, thereby enhancing research governance and fostering a culture of integrity across African universities. (shrink)

The research aims to harness spatial interpolation techniques to produce maps with a high level of perceptual accuracy in representing the population data of the study area. This is achieved after exploring the statistical and spatial nature of the databases used, analyzing them, and determining their distribution using a variety of spatial data exploration tools available within the GIS (Geographic Information Systems) environment. These tools contribute to evaluating the characteristics, distribution, and analysis of data, including testing data distribution, identifying its (...) direction, and uncovering its spatial correlations. This highlights the importance of the study and understanding the distribution pattern of the population data in the study area, thereby facilitating the preparation of future that serve spatial organization by building spatial models for the numerical distribution of the data for age groups: young, middle-aged, and elderly, at the level of administrative units of the study area by relying on the inductive approach and the quantitative analysis approach. This is done using Geostatistical Analysis methods within the concept of spatial interpolation in GIS. The research also seeks to predict the population maps for Thi Qar Governorate by comparing spatial interpolation methods, namely Inverse Distance Weighting (IDW) and Simple Kriging (SK). The study concluded, after verifying the accuracy of the results using the Cross-Validation curve, that the Simple Kriging (SK) method is the most accurate model in spatial prediction of population data for representing the data of the young age group in the study area, as it had the lowest Root Mean Square Error (RMSE) of 10.012. It was followed by the Inverse Distance Weighting (IDW) method for representing the data of the elderly age group with an RMSE of 350.48. This indicates that the use of statistical criteria improves the accuracy of spatial interpolation and that the spatial prediction of the population data for the study area using the Simple Kriging (SK) method was more accurate than the Inverse Distance Weighting (IDW) method based on statistical indicators. The novel COVID-19 has created an exogenous shock to capital markets and, hence, an ideal opportunity for researchers to assess whether CSR-related activities provide an insurance-like mechanism to protect firms against the shock. Using a large sample of 4361 firms domiciled in 40 countries, we investigate the roles of CSR reporting and assurance in the negative consequences of COVID-19 on firm value. The results confirm that prior CSR reporting experience buffers firms against the adverse effects of the health crisis. The (...) results also support that not only does the assurance on CSR reports create a buffering effect against the health crisis, but it also intensifies the buffering effects of prior CSR reporting experience against the pandemic. Moreover, using difference-in-difference method for testing the link between CSR reporting and firm value, we show that the positive association of reporting and assurance with firm value is more pronounced during the pandemic as compared with the years preceding it. The results of this study are robust to various analyses. Replicating the analyses to the context of the global financial crisis, we find that prior CSR reporting experience and assurance provide similar buffering effects when a market is exposed to various exogenous shocks. The results also hold for the mandatory disclosure regimes. By distinguishing first and subsequent reports and assurance, we show that, unlike subsequent CSR reports and assurance, the initial ones cannot mitigate the negative effects of the crisis on firm value, indicating that stakeholders take into account longer-term CSR reporting experiences. Aside from reporting and assurance aspects of CSR, we analyze the role of CSR report's quality and accuracy and show that the adoption of Global Reporting Initiatives (GRI) frameworks can enhance socially responsible firms' resilience against systematic shocks. As a consequence, it is being confused with activities contrary to its teachings. Islam has an elaborate treatment for almost every aspect of life including the affairs of business. Business is an acceptable and dignified occupation, which has to be conducted within the given frameworks. Islam encourages the creation, acquisition and consumption of wealth, and the fulfilling of certain (...) conditions in so doing. Wealth is held in trust as a gift from God. The terms of reference of this trust are to be complied with. Ethical principles do play a major role in shaping the behavior of a Muslim, in or out of business. Drawing on the historical insight of Emer de Vattel to build on the contemporary arguments of Michael Walzer and David Luban, this article develops a model of sufficient risk as a necessary condition for anticipatory war to be deemed self-defence. This model holds that an anticipatory war may constitute legitimate self-defence (as opposed to aggression) when it aims to forestall a threat that poses a sufficient risk to the anticipating state. This is the point where a threat is both sufficiently (...) likely to materialise and sufficiently large to pose a grave risk. Due to crucial problems with the imminence condition for self-defence, I propose that the sufficient risk condition subsume that of imminence. The power of this model lies in its ability to encapsulate all factors raised by previous authors that are morally relevant specifically for anticipatory wars and categorise them as contributing to the judgement of the likelihood of the threat materialising and/or the magnitude of the potential threat. This parsimonious categorisation increases the accuracy and clarity of the moral theory on anticipatory war, making it more robust to change in the types of threats faced by states, and less ripe for manipulation to justify immoral wars. This study sought to gauge ethical attitudes about professional boundary issues of physicians and nurses in the Kingdom of Saudi Arabia. Respondents scored 10 relevant boundary vignettes as to their ethical acceptability. The group as a whole proved “aware/ ethically conservative,” but with the physicians' score falling on the “less ethically conservative” part of the spectrum compared to nurses. The degree of ethicality was more related to profession than to gender, with nurses being more “ethical” than physicians.

The professions have focused considerable attention on developing codes of conduct. Despite their efforts there is considerable controversy regarding the propriety of professional codes of ethics. Many provisions of professional codes seem to exacerbate disputes between the profession and the public rather than providing a framework that satisfies the public''s desire for moral behavior.After examining three professional codes, we divide the provisions of professional codes into those provisions which urge professionals to avoid moral hazard, maintain professional courtesy and serve the (...) public interest. We note that whereas provisions urging the avoidance of moral hazard are uncontroversial, the public is suspicious of provisions protecting professional courtesy. Public interest provisions are controversial when the public and the profession disagree as to what is in the public interest. Based on these observations, we conclude with recommendations regarding the content of professional codes. (shrink)

Two types of variables impact face recognition: estimator variables that cannot be controlled and system variables that are under direct control by the criminal justice system. This article addresses some of the reasons that eyewitnesses are prone to making errors, particularly false identifications. It provides a discussion of the differences between typical facial memory and eyewitness studies and shows that the two areas generally find similar results. It reviews estimator variable effects and focuses on system variables. Traditional facial recognition researchers (...) rarely study system variables but reveal important factors that police and policy makers should consider with regard to eyewitness identification and the courts. It concludes that there is still room for considerable improvement in identification procedures and wants to encourage more system variable research as a means of reducing wrongful convictions. The importance of enterprises significantly improving their innovation performance by working closely with customers throughout the innovation process has been emphasized in recent literature. However, the role of organizational innovation environment in customer creativity and the impact of customer knowledge matching on the innovation environment are not sufficiently explored. Based on the Social cognitive theory and Flow theory, his investigate the factors that influence enterprise innovation performance in the context of customer participation in innovation, as well as how businesses can (...) foster an online innovation environment that fosters customer creativity. The mixed-methods study, which combines qualitative and quantitative research, is used to create the scale item that measures the study’s main variables. Structural equation modeling and bootstrapping estimation was performed on survey data collected via questionnaire from 392 consumers who participated in online service innovation in an online virtual brand community between June 2018 and May 2019. The study obtain the following main results. First, the innovative environment of customer online participation in service innovation fosters customer creativity. Second, two mediation interactions exist: creative self-efficacy and positive emotions, both of which partially mediate the relationship between customer creativity and the innovation environment. Third, while customer knowledge matching influences the intermediary effect of creative self-efficacy on innovation environment and customer creativity, it has no effect on the intermediary effect of positive emotion on innovation environment and customer creativity. The U.S. Supreme Court’s approach to human rights is a global outlier. In conceiving of rights adjudication in categorical terms rather than embracing proportionality analysis, the Court limits its ability to make the kinds of qualitative judgments about rights application required to adjudicate claims of disparate impact, social and economic rights, and horizontal effects, among others. This approach, derivative of a private-law model of dispute resolution, sits in tension with the rights claims typical of a pluralistic jurisdiction with a mature (...) rights culture, in which litigants more often disagree, reasonably, about the scope of rights rather than deny that others have them at all. In order to overcome the mismatch between the nature of the rights claims the Court faces and its anachronistic technology of adjudication, it will need not only to adopt a form of proportionality analysis but it will also need to adjust the ways in which it receives and assesses empirical social facts and it will need to broaden its remedial toolkit to include, for example, suspensions of invalidity. While proportionality is far from perfect, its flaws are anticipated by the challenges of constitutional democracy itself under conditions of pluralism. (shrink)

In this address, Mumia Abu-Jamal argues that a sustained commitment to revolutionary activity is no accident, that it depends upon an initial and irrevocable choice to change intolerable social conditions. The individual who makes such a choice, Abu-Jamal recognizes, is often aware of the suffering that his or her decision may entail. Neil Levy mounts two arguments against Robert Kane’s influential libertarian theory. According to the first, because Kanean self-forming actions are undetermined, there can be no contrastive explanation for why agents choose as they do rather than otherwise, in which case how they choose appears to be a matter of luck. According to the second, if one grants Kane the claim that agents are responsible for their undetermined choices in virtue of the fact that they made efforts of will to choose (...) them, the fact that agents engage in dual efforts of will leads to an implausible doubling of the agent’s responsibility. We defend Kane from both objections. We argue against the first by clarifying the nature of contrastive explanation in the context of Kane’s theory and we argue against the second by showing that the kind of doubling of responsibility implied by an agent’s dual efforts of will is, in fact, innocuous. The work presented here investigates the process by which one group of individuals solves the problem of detecting deceptions created by other agents. A field experiment was conducted in which twenty-four auditors (partners in international public accounting firms) were asked to review four cases describing real companies that, unknown to the auditors, had perpetrated financial frauds. While many of the auditors failed to detect the manipulations in the cases, a small number of auditors were consistently successful. Since the detection of (...) frauds occurs infrequently in the work of a given auditor, we explain success by the application of powerful heuristics gained from experience with deceptions in everyday life. These heuristics implement a variation of Dennett's intentional stance strategy, which is based on interpreting detected inconsistencies in the light of the Deceiver's (i.e., management's) goals and possible actions. We explain failure to detect deception by means of perturbations (bugs) in the domain knowledge of accounting needed to apply these heuristics to the specific context of financial statement fraud. We test our theory by showing that a computational model of fraud detection that employs the proposed heuristics successfully detects frauds in the cases given to the auditors. We then modify the model by introducing perturbations based on the errors made by each of the auditors in the four cases. The resulting models account for 84 of the 96 observations (i.e., 24 auditors × four cases) in our data. (shrink)

Diabetes mellitus (DM) is a colossal burden in global health, its prevalence increases steadily throughout the world. This systematic review explores the pathophysiology and epidemiology of diabetes, which describes the interactions that implicate that is the result of the play between genetic, environmental, and lifestyle factors in the development and progression of the disease. The review also describes a plethora of pharmacological treatments available to manage diabetes, with the oral agent, insulin regimens, and new approaches to therapy. Integrating the wisdom (...) of the best clinical guidelines, those are from American diabetes association (ADA), European association for the study of diabetes (EASD), and International Diabetes Federation (IDF). Since these reviews are consistent with normative standards for evidence-based recommendations of optimal care of diabetes. The review goes further to cover technological advances in the management of diabetes. They include Continuous Glucose Monitoring, advanced insulin delivery systems, and Artificial Pancreas Systems. Such technologies hold more promising routes to better glucose control and patient quality of life. All this comes along with challenges that their deployment and maintenance that run through economic, adherence issues, and unequal access to healthcare. The future research and innovation in the battle against DM will include the application of personalized medicine and the development of advanced digital health solutions. This article will become a treasure for health professionals, researchers, and policymakers who have dedicated themselves to battling the adversities of diabetes mellitus. (shrink)

Trolley dilemmas have been used to justify the intuitive appeal of the doctrine of double effect. According to this doctrine, if a good action has a harmful side effect, it is morally acceptable to do it, provided the harmful effect is not intended. However, in some variants of the dilemma, most people are willing to forego this doctrine, thus making responses inconsistent. In this study, 404 university students from the United Arab Emirates (UAE) were presented with 4 versions of the (...) trolley dilemma. Results came out showing that higher levels of depressive symptoms predict greater consistency in adherence (or rejection) to the doctrine of double effect. Likewise, higher levels of depressive symptom predict utilitarian responses to trolley dilemmas. Anxiety symptoms had similar effects, but more moderate. Demographic variables (age, gender) were also assessed as predictors of responses and consistency to trolley scenarios, but no significant effects were found. (shrink)

This research study was aimed to examine the cross-national coverage and framing patterns about Jamal Khashoggi’s murder in international media through focusing on newspapers. Khashoggi; an internationally acclaimed US based Saudi journalist was brutally assassinated at Kingdom’s consulate in Turkey which created the global outcry. As this issue made headlines worldwide for several months, the media from USA, Kingdom of Saudi Arabia, and Turkey; the most substantially and politically involved countries presumably used certain framing patterns in their coverage. To find (...) out the difference in coverage intensity and media frames, a content analysis based comparative study of US, Saudi and Turkish newspapers was conducted which is guided by the framing theory of Mass Communication. The results showed that the media from three selected countries dealt the same issue with significant differences in coverage and framing patterns. We concluded based on our findings that such differences in cross-national coverage patterns were influenced by the respective state’s ideology, interests, governance system, public narrative, or media settings. This study also explored some facts regarding freedom of expression and about journalists who have been targeted in reprisal of their professional work all over the world. The findings of the study elaborate that most of the newspapers used anti-Saudi frames in their coverage. So far as overall coverage is concerned Turkish and US papers provided a significant coverage to the issue while newspapers from Saudi Arabia provided least coverage to the issue as their media are highly state bound. Using Reidenbach and Robin‘s ( Journal of Business Ethics 7, 871–879, 1988) multi-criteria ethics instrument, we carried out the first empirical test of Robertson and Crittenden‘s (Strategic Management Journal 24, 385–392, 2003) cross-cultural map of moral philosophies to examine what ethical criteria guide business people in Russia and the U.S. in their intention to behave. Competing divergence and convergence hypotheses were advanced. Our results support a convergence hypothesis, and reveal a common emphasis on relativism. Americans are also influenced by the (...) justice criterion while Russians tend to emphasize utilitarianism. (shrink)

The authors provide a concise analysis of the changing political economy of race, incarceration, political imprisonment, and execution in the U.S. criminal justice system. The article goes on to describe the circumstances surrounding the arrest, conviction, and impending execution of the black militant, Mumia Abu-Jamal. From here the discussion turns to an examination of the political efficacy of various boycott strategies and tactics, and, in closing, begins to outline a specific plan of action aimed at preventing Abu-Jamal’s execution.
